What should happen now?

Thursday, Mar 28, 2013 (nine news)

[ Tauri Litchfield died in hospital after being found unconscious in a car park with severe head injuries on March 17.

Media reports suggested the man was set upon while trying to come to the aid of a girl, whom he did not know, who was being attacked.

Overnight, Major Crime Squad detectives charged a 15-year-old boy from Mandurah, a 14-year-old boy from Leda and a 14-year-old boy from Thornlie, all in Perth's south, with murder. ]

This type of crime seems to be on the increase, how can we prevent similar incidents and how should the authorities deal with this onw?

I reckon they should be put in jail with only basic reading material and maybe a radio for entertainment and made to undergo training courses.

Another story from Melbourne  tells of a bloke who pleaded guilty yesterday to murdering his 2nd victim just 9 days after completing parole after serving 13 yrs in prison for the  stabbing murder of an 18yr old girl in 1986, Why was he released at all, ?

I can see what your getting at Maggs however I,m confused by your final question . The question seems to indicate that a life sentence should have been imposed with no parole . I think at present the only way to do that under present laws is some form of detention at the governors pleasure . To have a blanket form of sentencing for murder as in life conviction would eliminate mitigating circumstances .

I was amazed at the recent success of the Patel appeal but I wasn,t in court to know the legal reasons why . We get the verdict and a few words saying this or that . I can never understand how a bankrupt can live the high life because their partner has the assetts in their name instead of the bankrupt . How can Tinkler pay tax on 9,000 bucks yet be a coal  wheeler and dealer owning a stud farm ?

The second case you mention in Victoria suggests the man is not suitable for release into the general public . The second murder is what suggests that position . How would any judge or jury have the knowledge or presumption that he would kill again ?

Geomac, if this guy had murdered your 18yr old daughter in a frenzied stabbing attack would you not be upset that after only 13 years he gets another chance at a life of which your child was robbed, ( mitigating circumstances?)

As for the 3 teenagers, what d'you think should be done with them

Maggs I would be devastated , angry and confused . I would consider revenge . I wasn,t saying right or wrong just confusion to your question . Thats why I said about a blanket sentence for murder . Like people , life and partners there are no black and white murder cases .

I saw a thing last night about a cop in NSW , 7.30 ABC I think it was , good piece .As to the 3 teenagers which I didn,t comment on they will be dealt with under existing law in WA . Thats all I can say in relation to that knowing hardly anything about the incident . Your assuming they are already guilty and convicted with the question what do you think should be done with them ? Are all three guilty and guilty of what ? Perhaps the question should be what is the best way to handle offenders of such crimes .

And this relates to the OP how?

The vagaries of the laws and justice system Maggs .

While it is not specifically mentioned, I would be willing to bet that the three boys in question were of aboriginal or islander ethnicity. These ethnic groups seem to make up a disproportionat number of the offenders in similar cases. They seem to know that they can get away with just about anything with only a 'slap on the wrist" before they turn 18. Before branding me a "racist", I would acknowledge that there are similar problems with caucasian teenagers in some areas.

I would suggest that if they commit an "adult crime" they should get an "adult punishment". Leniency to juveniles hardly rehabilitates them, it just delays their entry into "big boys" prison.

I agree with you kfchugo - if they commit an adult crime, they should be treated as adults, names released, the whole kit and caboodle.  Why should an adult who may have committed a crime with juveniles have their name released, but not the juveniles?  If they can kick someone to death, they don't deserve any special treatment because of their age.  There are no extenuating circumstances for this sort of behaviour.

But my point is that we all know they will not be treated as adults, in most of the places they send these young thugs, they have access to laptops, play stations etc, these being things which are considered vital in their rehabilitation, myself, I'd also give them a few lashes of the birch to humiliate them and make them think twice about what they've done and providing luxuries such as electronic games while giving them a comfy bed and 3 meals a day is too much imo

As for the 2nd instance, this bloke killed a young woman then did it again when released just 9 days after his parole ended, should be life for murder.

Yes Geomac, if he'd defrauded the Government he probably would've got a longer sentence

The student and budding justice worker had no idea of Hunter's criminal history. He served a 13-year term for stabbing 18-year-old Moonee Ponds woman Jacqueline Mathews in 1986.

I,m not sure about the timeline Maggs but I,m assuming that Hunter was released on parole in 1999 or after . So the 9 days after parole finished was not when he was released from prison but when his parole period elapsed . Probably not relevant but that part of it seemed out of whack .

s Geomac, if he'd defrauded the Government he probably would've got a longer sentence

Quite the opposite I would have thought , couple of years at most . HIH comes to mind , not govt but similar and 4 years ? Jodey Rich , cant remember who it was .

["I'm shocked... or concerned about it. I mean it is an absolute tragedy to see kids this young charged with such a serious offence," he said.

"It's always a shock to see kids involved in crimes, but I mean this is a very serious crime for a young person to be involved in, so I think we should all be very sad about that.

"You know you have to ask all sorts of questions about their background and what led them to this type of lifestyle so we'll find that out in time no doubt."]

Nothing about the victim here

I saw a few articles about a rape in the USA where the major networks had stories on the football careers of the perpetrators as in ruined . College football prospects but bugger all about the victim , causing a lot of flak . What about the victim type thing .

Geomac, I did in fact say it was at the end of his parole period, he is 47 yrs old now

and these kids have been charged already, but I'm sure there were mitigating circumstances as to why they were witnessed jumping on and kicking the bloke in the head

[Are all three guilty and guilty of what ? Perhaps the question should be what is the best way to handle offenders of such crimes . ]

and as usual in these cases, the victims and their family's don't rate.

Sorry if I seem irate, don't mean to be but kids get away with so much and are not punished for wrongdoing, instead it's always some other person/ thing's fault that they don't know right from wrong

Maggs

Yes you did and I wasn,t implying otherwise . I was pointing it out for those who like me were not sure of the timeline . Sometimes even when I read a statement in an article two or three times I,m left unsure what that statement is actually saying .

I wonder if they will offend again something like the Bolger murder...they are both out here but under assumed names..one is already in prison for offences to minor/s.....I don`t th ing drugs were an issue there....

Also the persons involved on this recent murder/stint will they offend again and them being aborgines...something somehow will have to change before we are all locked into our homes for one reason or an other.....and terrorised as well......

Seggie. When young, I believed in justice. Now I shakes me 'ead.

What about past crimes not being used in a trial? madness in my book.

No wonder the kids are feral, the rellies outside the court were a lovely lot as well spitting and abusing others who were there

The real problem is that cockroaches are immune to most insect sprays.  It is a pity that we don't allow these scum to be dealt with by aborigine law.  A pear in the leg is seldom followed by a second one, regardless of age.

If a tribal offence don't they also get punished under Aboriginal law as well? Can't allow it all to go under tribal law tho' that would be used as grounds to bring in Sharia Law.
