Letter from the Fair Trading Department

I received a letter today from Fair Trading stating they want assistance from the public regarding loose-fill asbestos. If your home is built before 1980 you can register with the NSW Government for a free sample test of the insulation in your home to find out if it is affected by loose-fill asbestos. It is critical the homeowners act as the NSW government is considering new laws to protect the community from unknowingly purchasing a property that contains loose-fill asbestos.

When selling a property, you would be obliged to confirm in the contract of sale if the property contains or is free of loose-fill asbestos and: A prescribed warning notice would be included in all contracts of sale to alert buyers of the risk of loose-fill asbestos in pre-1980s homes.

Owners of properties that test positive for loose-fill asbestos have the option to either sell their land and premises, or premises only, to the Government. The Government assistance program is your chance to protect yourself from the financial consequences of loose-fill asbestos.

Apparently this letter is being sent out to many residents. Thought you might interested.

Obviously your post didn't attract any response Hola, which surprises me given the fact that a lot of members in here are of an age where homes where built with loose fill aspestos,

Lets hope residents that it does effect get assistance to their satisfaction for their health sake. :)

The third paragraph down is a bit of a worry Cranky as it says "if your home tests positive for loose-fill asbestos you have the option to sell your land and premises to the government." This would be only market value and the owners could be very out of pocket. I and all the owners of the Block I live in should be free but won't know until the test is done.

Hola, we sold our 1980s house a couple of years ago. Was way too large and then built again. Have no idea what condition the old place is in, but will pass on this information to the owners. We keep in touch.

Thanks for that.

Did not know it affected properties in NSW ... thought it was limited to ACT where it is known as Mr Fluffy loose-fill asbestos used for insulation.

The NSW Government is providing free sample testing to owners of pre-1980s residential premises in 28 identified NSW local government areas and a limited offer of free sample testing has been extended to an additional 35 local government areas in Southern NSW.
