Mike Smith off 2UE because he had a story re Juliar

BROADCASTER Michael Smith has taken Fairfax Radio to court, accusing radio station 2UE of planning to sack him for his political beliefs.

Smith was suspended earlier this month after he tried to air an interview with a former union official claiming allegedly fraudulent conduct by a former boyfriend of Julia Gillard.

It's understood he will contest his expected dismissal under the Fair Work Act, alleging he has been victimised over his political beliefs.
The 2UE afternoon presenter told The Australian Online today: “We are seeking an injunction to restrain my employer from dismissing me.”

Later this afternoon, a federal magistrate in Sydney granted an order restraining 2UE from sacking Smith on the basis that such a dismissal would contravene the Fair Work Act.

Magistrate Shenagh Barnes granted the order at an “urgent” hearing in Sydney, as Smith was concerned he would be terminated by 2UE before the matter could be fully heard in court
sign a petition here if you think his freedom of speech and the ability to air it is being stifled by draconian actions smacking of the communist Soviet Union.

The Greens are behind the media enquiry but Julia Gillard did not like the story re her and the Union Official which we have not been told in detail and if it were slanderous she could sue and get them that way surely?

Oh and so Fwed the rusted on Labor supporter who can only cut and paste left wing media items can stop searching - here is a link to Crikey a 'left wing' site which supports Juliar so you can read between the lines or suck it all in and ignore the old saying "Where there is smoke there if fire"

and for balance here is a 'right wing' site for those who like to make up their own minds.

I could not get the link to the stat dec to work.

Maybe someone else can? or maybe it has been silenced...........who knows 'shrug' my confidence in our democracy these days is a bit shaky to say the least!

Some weeks ago, I received an email with details of this allegation. It included a transcript of the statutory declaration detailing the allegations against Gillard and the union official. It looked "kosher" to me although these things are very easily "photo-shopped" these days.

The allegations were serious and damning and in my view were a real threat to Gillards continuation as Prime Minister and I, for one, would like to see them aired publicly and thoroughly investigated. While I (like many Australians) have no love for Gillard, I will not pre-judge her, but nobody is above the law and she needs to address these allegations and respond. If they are correct, the law must take its course...... if they are false, the instigators must be brought before the courts and pay the penalty for (a) signing a false declaration and (b) impugning and slandering a prominent public figure.

Kfchugo, I agree that the stat dec should be examined. But in effect is a side issue.

But, also, BigVal's headline is the fundamental worry.  We are supposed be living in an enlightened age,, in a democracy which prides itself on free speech.  Mike Smith was suspended...before he'd even interviewed the union official.    Something is very wrong here if a broadcaster is taken off air, before he's even said anything.   The implication here is, that the order came from high circles.

There is an article this morning at the Australian, which everyone should read.

We are in grave danger of losing much of what we now take for granted, if these issues are not confronted head on.

From the article mentioned:

For anyone who believes in unfettered freedom of the press - that is, in the freedom of anyone to publish what they believe to be true and interesting - these are deeply worrying times.

The piece is by Brendan O'Neill, who is not a conservative, but quite openly, a Marxist!

Link to the article.

I actually posted this to discuss the threat to freedom of free speech as this is what is happening and not only to Mike Smith who is addressing his problem via Fair Work and good luck to get an answer to that - like someone recently said - 2 years and the man handling the complaint is elevated to a Commissioner with their complaint unresolved.

Thanks for the link Koko - glad somone else is worried too. I value my right as well as others do, our right to express our opinions as freedom of speech and I for one, wont take it lightly to lose that right.

For this to keep rearing its ugly head and the Stat Dec may or may not be valid - but it should have been investigated by Vic Police back then. And now if not. And with a new Liberal Government who are not obliged to favour the Unions as do not take their donations for favours, maybe at last it will be.

Either way it has to be able to be published in newspapers as long as it is not slander and their lawyers are always there to check it out  - obviously some heavy influence has been at work here and also with the ABC too to sack Glenn Milne off Insiders.

This is Un-Australian to use the favourite vernacular of the day.
